Website and Workflow Study terms

These terms are provided in English, Bahasa Melayu, and Simplified Chinese for accessibility. The English version controls if a translation conflicts with it.

Operator and acceptance

Boinkergy is a brand operated by Bryan Lau in his personal capacity. It is not a separately incorporated legal entity. References to “Boinkergy,” “we,” “us,” or “our” in these terms mean Bryan Lau operating under the Boinkergy brand.

These terms apply to boinkergy.com, its published material, and the Workflow Study application stage at app.boinkergy.com. By using the website or submitting an application, you acknowledge these terms. If you submit an application, you agree to the provisions that govern the application and Workflow Study. Do not submit an application if you do not agree to them.

Additional participation information will apply before a discovery interview. Separate pilot and product-account terms will be provided for agreement before access to those stages.

Eligibility and authority

An applicant must be at least 18 years old and authorised to provide the submitted information on behalf of the identified company. One application represents one company and company MYeHALAL account ID. An applicant representing more than one company must apply separately for each company.

You must provide accurate, current information and only information you are entitled to share. Do not submit certificates, portal credentials, client lists, formulations, or other confidential or sensitive operational material through the public form or ordinary email.

Informational material

Articles and other public material are provided for general information. They do not replace official requirements, professional advice, a manufacturer’s own controls, or an authority’s assessment. Official systems and the responsible authorities remain authoritative. You are responsible for checking current requirements and deciding whether and how to act on public material.

We aim to maintain accurate material but do not warrant that every page is complete, error-free, or current at all times. Publication does not guarantee certification, audit acceptance, regulatory compliance, commercial results, or any other outcome.

Workflow Study

The Workflow Study is a research and participant-selection activity for an in-development product. Applying does not prove eligibility, guarantee acceptance, create a product account, or guarantee a product launch date.

Participation is review-based. Accepted participants who remain eligible, continue participating, provide the requested feedback, and agree to the information or terms applicable to each stage are intended to progress from a 25-minute discovery interview to a prototype session, one month of pilot access at no charge when a working pilot is ready, and then product access. Pilot timing is not guaranteed. Product access will be subject to the terms and pricing disclosed before that stage; the one-month no-charge commitment applies only to qualifying pilot access.

Participation is voluntary. A participant may stop participating, and we may decline, postpone, modify, or end an application or study stage where reasonably necessary because of eligibility, capacity, safety, confidentiality, research, technical, legal, or product-readiness considerations. We will not use this discretion to retrospectively impose a charge for the stated one-month pilot.

Participation does not create employment, partnership, agency, exclusivity, or ownership of Boinkergy or its product. No applicant or participant may represent that it speaks for Boinkergy or that participation signifies endorsement, certification, official verification, or affiliation with JAKIM, MYeHALAL, or any government body.

Sessions, feedback, and publicity

Interviews and prototype sessions are not recorded by default. Any proposed recording requires advance notice and the participant’s express agreement. Identifiable quotations, screenshots, case studies, company names, or other participant material will not be published without separate express permission.

Participants retain ownership of their pre-existing materials. By providing feedback, suggestions, or observations, a participant permits us to use them without charge for internal research and product development, provided we do not publish identifiable confidential information. We may use anonymised or aggregated findings in marketing where they are presented in a way reasonably designed not to identify the participant, its clients, or other individuals.

Intellectual property and permitted use

Unless otherwise stated, the website, its original text, branding, design, and other original materials are owned by Bryan Lau or used with permission. You may access and make reasonable internal reference copies for lawful business evaluation. No other licence is granted.

You must not misuse the website or application, interfere with their operation or security, attempt unauthorised access, introduce malicious code, impersonate another person or company, scrape them at a level that impairs service, or use their material in a misleading way. Links may be shared if they do not imply endorsement or affiliation.

Third-party services and links

The website may link to official sources and third-party services. Those services are controlled by their respective operators and may have separate terms and privacy notices. A link does not by itself mean that Boinkergy endorses, controls, or is affiliated with the third party.

Availability and liability

The website and application may be changed, suspended, or unavailable. To the extent permitted by law, they and their public material are provided without implied guarantees beyond rights that cannot lawfully be excluded.

To the extent permitted by law, Bryan Lau will not be liable for indirect or consequential loss arising solely from use of, inability to use, or reliance on the public website or general informational material. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud or fraudulent misrepresentation. Applicable statutory and consumer rights remain unaffected.

Privacy

Our Privacy notice explains how personal data is handled. Additional privacy and participation information may be provided before later study stages.

Changes and termination

We may update these terms prospectively by publishing a revised version and effective date. A material change affecting an existing application or participant will be communicated where reasonably practicable and, where required, presented for agreement before it applies. You may stop using the site or withdraw from the study if you do not accept a prospective change.

Rights and provisions which by their nature should continue—including intellectual-property, confidentiality, feedback-use, liability, and governing-law provisions—survive withdrawal or termination.

Governing law and general provisions

These terms are governed by the laws of Malaysia. Subject to any mandatory right or law requiring otherwise, the courts of Malaysia have jurisdiction over disputes relating to these terms.

If a provision is held invalid or unenforceable, the remaining provisions continue to apply. A failure or delay in exercising a right is not a waiver of that right. These terms and any stage-specific terms presented for agreement constitute the applicable agreement for their stated scope; stage-specific terms prevail for that stage if they expressly identify a conflict.
